MOSBY DEFENSE REQUESTS MOTION TO DISMISS

Attorneys for Baltimore City State’s Attorney Marilyn Mosby are asking the court to dismiss two perjury counts against her.  In their filing on July 8th, Mosby’s attorneys said she had not influenced a “decision-making body” by checking the box, stating she suffered “adverse financial consequences” related to COVID-19.  Mosby withdrew money from her retirement fund through a CARES Act provision that waived penalties for people adversely affected by the pandemic.  She used the money for down payments on two Florida vacation homes.
