COMMONWEALTH COURT HALTS STATE’S PROPOSED ENTRY INTO REGIONAL CAP-AND-TRADE INITIATIVES

A Pennsylvania Commonwealth Court has stopped the state’s proposed entry into regional cap-and-trade initiative. A panel of judges late last week ruled that the state should not move forward with a proposed entry into the Regional Greenhouse Gas Initiative. The plan has experienced delays since it was first announced by former Governor Tom Wolf four years ago. The Commonwealth Court judges ruled that entering RGGI would result in a new tax, and as such, the move should only be accomplished through an act of the Legislature rather than by executive action.
