HERSHEY’S ADDS NEW DISCLAIMER ON REESE’S PUMPKINS

Reese’s Peanut Butter Pumpkins now carry a new warning: “Carving not on actual product.”  The change follows a lawsuit accusing Hershey of deceptive marketing because the candies were pictured with jack-o-lantern faces, but the actual chocolates were blank.  A Florida judge dismissed the case last month, saying the plaintiffs suffered only “subjective disappointment.”  The lawsuit sought five million dollars and also involved other Reese’s holiday shapes.  Hershey has not explained why it changed the disclaimer from “Decorating Suggestion.”
