The state’s previous abortion law remains locked due to a 1975 injunction. That year a federal appeals court ruled the state’s law from the 1880’s as unconstitutional, and despite the recent Supreme Court’s decision on Roe v. Wade that old law is not in effect. The injunction is keeping the old law from being enforced, so the state will now be tasked with challenge the injunction, or create a new state law to deal with abortion.
