West Virginia State Attorney General J.B. McCuskey has ordered that future opioid settlement money be redirected from the West Virginia First Foundation to the state legislature. Since 2022, settlement funds have been split, with 72-point-5 percent going to the foundation and the rest going to the state and local governments. McCuskey says future settlement money will instead go into the state’s general revenue fund, to be spent as lawmakers decide. Foundation Director Jonathan Board says the change only affects future litigation, and that the foundation, which has received about 330-million-dollars to date, will continue its work as planned.
