Maryland’s Anthony Brown has joined a coalition of 22 attorneys general in supporting litigation challenging the DHS practice of making immigration arrests without warrants or proper cause. Under federal law, immigration officers conducting warrantless civil arrests must have probable cause to believe an individual is unlawfully in the U.S. and likely to escape before a warrant is obtained. Brown and the coalition say the DHS routinely carries out warrantless arrests without determining if the individual is an escape risk. He says the coalition is urging the court to ensure ICE follows the law, just like any other law enforcement agency.
